So you just found your dream home and you decided to write an offer on the home and get a contract on it before that other couple looking at it does. You get with your REALTOR and write an offer and your agent submits it on your behalf. Did you know that without the attached Confidentiality Agreement being filled out and submitted with your offer that your offer is NOT confidential? For the most part agents in the state of Tennessee believe that they are because many years ago they were.

So how do you use this information to help you get the home of your dreams? First off have your agent call the listing agent and ask if there is an offer on the property. If there is ask him to get the specifics on the offer so that you can beat the existing offer. At this point as you are signing the paperwork for your offer make sure that the Confidentiality Agreement is signed and submitted with your offer. If you really want to win in a multiple offer situation the add an Escalation Clause in your offer and it will increase your odds of winning.

This information is not intended to be legal advise or to develop any kind of agency relationship

This is not the case in all states and make sure to consult with a REALTOR in your state.
